1. Acceptance of Terms

By accessing or using delhitokashipurtaxi.com ("Portal", "we", "us", or "our"), submitting booking requests, or contacting partner operators through our links, you ("User", "Traveller", or "Passenger") agree to be bound by these Terms of Referral Service. If you do not agree to these terms, you must refrain from using the Portal.

2. Nature of Service: Electronic Intermediary Only

The Portal operates strictly as a lead generation, technological facilitator, and referral intermediary under Section 79 of the Information Technology Act, 2000 (India):

• No Ownership of Fleet: We do not own, maintain, inspect, lease, or operate commercial taxis, cabs, or buses.
• No Employment Relationship: Drivers and transport contractors are entirely independent third-party operators. No master-servant, employer-employee, or principal-agent relationship exists between the Portal and any driver or taxi firm.
• Independent Contract of Carriage: When you agree to a taxi booking, the legal contract of transportation is executed strictly and solely between you and the respective independent taxi operator.

3. Indicative Fares & Toll Disclaimers

All fare tables, kilometer rates, and time estimates published across delhitokashipurtaxi.com are indicative reference benchmarks provided for informational guidance only. The final fare, inclusion of highway FASTag toll taxes, state border commercial passenger taxes (Uttar Pradesh / Uttarakhand), airport parking, and driver night allowances must be explicitly verified and contracted directly with the partner operator.

4. Limitation of Liability

To the maximum extent permitted by applicable Indian law, Delhi to Kashipur Taxi, its proprietors, affiliates, and technical agents shall NOT be liable for:

• Any vehicle breakdown, mechanical failure, flat tyre, or highway delay;
• Missed flights at Indira Gandhi International Airport (DEL), missed train connections at Anand Vihar / New Delhi / Old Delhi stations, or missed appointments;
• Road traffic accidents, personal injury, property damage, loss or theft of luggage, or acts of God (including landslides, heavy fog, or waterlogging);
• Disputes arising over fares, pricing discrepancies, cancellation penalties, or refunds between the passenger and the taxi operator;
• Any behavioral misconduct, reckless driving, or unlawful acts committed by independent third-party drivers.

5. Passenger Conduct & Legal Obligations

When utilizing transportation arranged via partner operators, travellers agree to:

• Accurately state passenger counts and baggage volumes to prevent vehicle overloading under the Motor Vehicles Act, 1988;
• Refrain from carrying contraband, illicit substances, unauthorized arms, or hazardous chemicals;
• Comply with state commercial border inspection procedures and tax declarations;
• Treat drivers with dignity and respect reasonable highway driving safety regulations.

6. Governing Law & Dispute Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of India.
